01   /   Agreement & Scope

Before You Use Our Website or Purchase From Us

These Terms of Service explain the rules that apply when you use Marketing Media AI, purchase our services, enroll in a workshop or program, or otherwise interact with our paid offerings.

These Terms of Service (“Terms”) form an agreement between you and Marketing Media AI (“Marketing Media AI,” “we,” “us,” or “our”) and govern your access to and use of marketingmediaai.com, as well as your purchase or use of our creative services, digital offerings, workshops, courses, live programs, resources, and related services.

By accessing or using our website, submitting an order, purchasing a service, completing a checkout, or enrolling in a paid program, you acknowledge that you have read, understood, and agree to be bound by these Terms.

If you purchase on behalf of a company, organization, or other entity, you represent that you have authority to accept these Terms on its behalf.

What these Terms cover

These Terms are intended to serve as the master terms governing the primary ways customers and participants interact with Marketing Media AI.

Website Use

Your use of the Marketing Media AI website, content, forms, resources, and other website features.

Services & Projects

Creative services, video production, AI-assisted work, digital services, project-based work, and recurring service arrangements.

Workshops & Programs

Paid workshops, live programs, courses, replays, resources, community participation, and related educational offerings.

Project-specific and purchase-specific terms

Certain purchases may also be subject to additional terms presented in a proposal, quote, checkout page, order form, statement of work, service description, or other written agreement. Those additional terms become part of your agreement with Marketing Media AI for that specific purchase.

If a specific written term directly conflicts with these Terms, the more specific term will control for that particular service or purchase unless otherwise stated.

Your use of our website and services is also subject to our Privacy Policy , which explains how we collect, use, and protect personal information.

03 / Using Marketing Media AI

Rules for Using Our Website

These provisions explain who may use Marketing Media AI, the standards that apply when accessing our website, and how privacy and communications are handled when you interact with us.

Eligibility

You may use our website, submit an order, purchase our services, or enroll in a paid program only if you have the legal capacity to enter into a binding agreement under the laws that apply to you.

If you are not legally able to agree to these Terms, you should not use portions of the website that require you to make a purchase, submit an order, or enroll in a paid offering.

Website Use

You may use the Marketing Media AI website for lawful purposes, including learning about our business, reviewing our offerings, contacting us, purchasing available services or digital offerings, and participating in programs for which you are eligible.

When using the website, you agree not to:

  • use the website for unlawful, fraudulent, abusive, or deceptive activity;
  • attempt to gain unauthorized access to the website, its systems, accounts, servers, or administrative areas;
  • introduce malicious code, interfere with website operation, bypass security measures, or intentionally disrupt another person’s use of the website;
  • use automated tools, scraping methods, or similar technology in a manner that places an unreasonable burden on the website or its infrastructure; or
  • copy, reproduce, republish, or commercially exploit website content in a manner that violates these Terms, applicable law, or the intellectual-property rights of Marketing Media AI or others.

Nothing in this section prohibits activity that cannot lawfully be restricted or any use that is otherwise expressly authorized by us.

Privacy & Communications

Our collection, use, and handling of personal information is described in our Privacy Policy. Please review that policy for additional information about how we handle information you provide through the website and our services.

When you contact us, submit an order, complete a checkout, register for a program, or otherwise provide contact information in connection with a transaction or requested service, we may use that information to communicate with you about the applicable inquiry, purchase, project, program, scheduling, delivery, account, or other service-related matter.

We may also send promotional or marketing communications when permitted by applicable law and consistent with the choices available to you. Where an unsubscribe or other opt-out mechanism is provided, you may use it to stop receiving the applicable promotional communications.

Opting out of promotional communications does not prevent us from sending non-promotional communications that are reasonably necessary to administer an existing transaction, project, purchase, or program.

04 / Services & Payments

Working With Marketing Media AI

These provisions explain how service scope, client responsibilities, pricing, recurring arrangements, project timing, revisions, cancellations, and refunds are handled when you purchase from Marketing Media AI.

Services & Orders

Marketing Media AI provides creative, marketing, video, digital, AI-assisted, educational, and related offerings as described on our website or in the materials provided for a particular purchase.

General descriptions on our website are intended to explain the nature of an offering. The specific scope of a purchase may also be described in a proposal, checkout page, invoice, written order confirmation, project brief, or other purchase-specific terms.

You are responsible for reviewing the scope, deliverables, and other material terms presented for your purchase before approving or completing the order.

Client Responsibilities

Some services require information, files, brand assets, footage, account access, instructions, approvals, feedback, or other materials from you. You agree to provide the items reasonably required to perform the work and to provide information that is accurate and complete to the best of your knowledge.

You are also responsible for reviewing materials submitted for your approval and for communicating requested changes, corrections, or concerns within the applicable project process.

Delays in providing required materials, access, decisions, feedback, or approvals may affect the project schedule. Material changes to your instructions or requested deliverables may also require a revised scope or quote before additional work begins.

Pricing & Payments

The price and payment terms applicable to a purchase are the terms presented for that specific offering or order, including any applicable service page, checkout, proposal, invoice, or other written purchase terms.

You agree to pay amounts that you authorize in accordance with the payment schedule and method presented for the applicable purchase. Payments may be processed through third-party payment providers, and your use of those providers may also be subject to their own terms and privacy practices.

If you request work that falls outside the agreed scope, we may provide revised pricing or a separate quote for your approval before performing the additional work.

Recurring Services

This subsection applies only when an offering is expressly identified as recurring, subscription-based, automatically renewing, or otherwise involving recurring charges.

For any such offering, the applicable price, billing frequency, renewal terms, and available cancellation method will be disclosed in connection with the recurring arrangement. By affirmatively purchasing or enrolling in that arrangement, you authorize the recurring charges described in the applicable purchase terms until the arrangement is canceled or otherwise ends in accordance with those terms.

A purchase that is not identified as recurring is not converted into a recurring service merely because you have previously purchased from Marketing Media AI.

Turnaround & Delays

Project timelines and turnaround periods identified as estimates are intended to provide a reasonable expectation of timing and are not guaranteed completion dates unless a specific deadline is expressly agreed to in writing.

Timing may depend on receiving the materials, access, instructions, decisions, approvals, or other client inputs reasonably necessary to perform the work.

When a project is delayed because required client input is not available when needed, the delivery schedule may be adjusted to reflect the delay and our then-current production availability.

Revisions & Scope Changes

Any revision allowance included with a service is determined by the terms presented for that particular offering or order.

Revisions generally address changes to work that remains within the agreed project scope. Requests for additional deliverables, substantial changes in direction, replacement source material, expanded functionality, new concepts, or other work outside the original scope may be treated as additional work.

If a request would materially change the agreed scope, we may provide a revised quote, updated scope, or separate order for your approval before performing that additional work.

Cancellations & Refunds

Cancellation and refund terms may differ depending on the type of service, digital offering, program, or other purchase. Any cancellation or refund terms presented on the applicable service page, checkout, proposal, invoice, order confirmation, or other purchase-specific agreement form part of the terms for that purchase.

Where a purchase-specific cancellation or refund policy applies, that policy should be reviewed before completing the purchase.

Nothing in these Terms limits any cancellation, refund, or other consumer right that cannot lawfully be waived or restricted under applicable law.

05 / Ownership & AI

Your Content, Our Work & AI-Assisted Creation

Creative projects often combine client-provided materials, original production work, reusable tools, licensed assets, and AI-assisted content. These provisions explain the rights that apply to each.

Client Materials

You retain any ownership rights you already have in materials you provide to Marketing Media AI, including your logos, trademarks, photographs, video footage, audio, written content, brand materials, data, and other content or assets.

By providing those materials to us for a project, you grant Marketing Media AI a non-exclusive permission to use, reproduce, edit, adapt, transmit, process, and incorporate them as reasonably necessary to perform the requested services and produce the agreed deliverables.

You represent that you have the rights, licenses, permissions, and authorizations reasonably necessary for the materials you provide and for the uses you request. This includes obtaining appropriate permission when submitted material contains content, music, trademarks, voices, likenesses, or other rights belonging to another person or organization.

If materials you provide are confidential, subject to special restrictions, or may not be processed using particular third-party software or AI tools, you must tell us about those restrictions before the affected materials are used in the project.

Intellectual Property

For purposes of these Terms, “Final Deliverables” means the finished work identified for delivery to you as part of the purchased service. Unless different rights are expressly stated in purchase-specific written terms, after full payment Marketing Media AI grants you a perpetual, worldwide, royalty-free, non-exclusive license to use the Final Deliverables for your own business, marketing, advertising, promotional, publishing, and related commercial purposes.

This license allows you to reproduce, publish, display, perform, distribute, resize, crop, edit, adapt, and otherwise use the Final Deliverables as reasonably necessary for those purposes. You may also provide them to employees, contractors, advertising partners, publishers, platforms, and service providers acting on your behalf.

Marketing Media AI retains its rights in materials and resources that existed before your project or that are designed to be reused across projects, including templates, systems, methods, processes, production techniques, prompts, workflows, know-how, reusable code, design systems, internal tools, and similar underlying materials. Your license to a Final Deliverable does not transfer ownership of those underlying resources.

Unless expressly included in the scope of your purchase, Final Deliverables do not include raw footage, editable project files, source files, working files, prompts, internal production files, unused concepts, alternate versions, or other materials used to create the finished work.

If a proposal, order, or other written agreement expressly grants different ownership or licensing rights for a particular project, those purchase-specific terms control for that project.

AI-Assisted Content

Marketing Media AI may use artificial intelligence and other technology-assisted tools as part of its creative and production process. Depending on the service, these tools may assist with activities such as ideation, image or scene generation, editing, enhancement, cleanup, variation development, transcription, organization, or other production tasks.

AI-assisted work may be combined with human direction, selection, arrangement, editing, compositing, design, writing, or other creative contributions. The availability and scope of intellectual property protection for a particular result may depend on the nature and extent of those human contributions and on applicable law.

Because generative systems can create outputs based on patterns learned from large amounts of information, AI-generated or AI-assisted elements may not be unique and similar elements may be generated for other users. Marketing Media AI does not represent that every AI-generated element is capable of copyright registration, exclusive ownership, or protection against similar independently generated material.

Where third-party AI platforms or technology providers are used, their applicable terms, technical limitations, and licensing conditions may affect particular AI-generated components. Nothing in these Terms transfers rights that Marketing Media AI does not own or have authority to license.

Third-Party Assets

Final Deliverables may contain or incorporate materials provided by third parties, such as stock imagery, stock footage, music, sound effects, fonts, software, plugins, templates, licensed media, or other third-party resources.

Those materials remain subject to any applicable third-party licenses, restrictions, and ownership rights. Your rights in the Final Deliverable do not give you ownership of a third-party asset or broader rights to that asset than the applicable license allows.

Where a third-party asset is licensed for use as part of a completed project, that license may permit use of the asset within the Final Deliverable without permitting extraction, resale, redistribution, sublicensing, or separate use of the underlying asset.

If your project requires exclusive rights, a particular commercial license, or use outside the standard rights available for an asset, those requirements should be identified before the affected asset is selected or incorporated.

Portfolio Rights

Unless we agree otherwise in writing or you notify us that a project is confidential or may not be used for promotional purposes, Marketing Media AI may display Final Deliverables that have been publicly released as examples of our work.

This may include displaying the work, reasonable excerpts from it, and your business or brand name in our portfolio, website, social media, case studies, presentations, proposals, and other materials used to demonstrate or promote Marketing Media AI’s services.

This portfolio permission does not authorize us to intentionally disclose confidential credentials, private account information, unreleased campaign materials, private analytics, proprietary source files, or other information that has been identified as confidential.

If you later ask us to stop displaying a particular project, we may make commercially reasonable efforts to remove it from promotional channels under our control. Removal may not affect materials already distributed, cached, archived, shared by others, or otherwise outside our reasonable control.

06 / Workshops & Programs

Participating in Our Workshops & Programs

These provisions apply to The Creative Build Room and to other workshops, courses, group programs, live sessions, educational offerings, and related program experiences offered by Marketing Media AI.

The Creative Build Room

The Creative Build Room is an educational and creative program offered by Marketing Media AI. The specific program format, schedule, included sessions, materials, access period, deliverables, bonuses, price, and other program details are those presented in connection with your enrollment.

Program content may include instruction, demonstrations, guided exercises, examples, live discussion, feedback, templates, resources, creative workflows, or other educational materials. Unless expressly included in the applicable offer, enrollment in a program does not include done-for-you client services or unlimited individual consulting.

We may make reasonable adjustments to the order, format, presenter, platform, timing, or delivery method of program content when needed to operate the program, provided that doing so does not materially eliminate the core offering you purchased.

Any purchase-specific terms presented for The Creative Build Room or another program form part of your agreement with Marketing Media AI for that enrollment.

Recordings & Replays

Some live sessions may be recorded and made available as replays when recording or replay access is part of the applicable program. Where a session is being recorded, Marketing Media AI will provide notice and will obtain any consent or acknowledgment required by applicable law.

Interactive participation in a recorded session may result in your name, image, voice, screen content, chat participation, questions, or other contributions being captured in the recording. If a session is designated for recording and you have concerns about being captured, you should raise them before participating in an interactive portion of that session.

Replay availability, duration of access, and the particular sessions included are determined by the terms presented for the applicable program. Unless expressly promised otherwise, temporary technical interruptions or the failure of a particular participant device, connection, or local recording function do not create a guarantee that every moment of every session will be available as a replay.

Participants may not independently record, reproduce, publish, livestream, distribute, or commercially exploit a program session or replay unless Marketing Media AI has expressly authorized that use.

Workshop Materials

Materials supplied through a workshop or program may include presentations, videos, recordings, worksheets, prompts, templates, examples, checklists, frameworks, written resources, downloadable files, and other educational content.

Unless different rights are expressly stated for a particular resource, your enrollment gives you a limited, non-exclusive, non-transferable license to access and use the provided program materials for your own personal or internal business learning and implementation.

You may use the knowledge, techniques, and skills you learn in your own work and business. However, you may not reproduce, resell, republish, distribute, sublicense, share access to, or create a competing educational product from substantial portions of the program materials themselves unless we expressly authorize that use.

Materials supplied by third parties remain subject to any separate license terms or restrictions applicable to those materials.

Community Participation

Some programs may include access to group discussions, community spaces, live chats, forums, messaging channels, collaborative sessions, or similar participant features.

When participating in those spaces, you agree to communicate respectfully and to refrain from unlawful activity, harassment, threats, impersonation, deceptive conduct, malicious disruption, unsolicited commercial solicitation, or posting material that infringes the rights of others.

You should not post another person's confidential information, private account credentials, sensitive personal information, or proprietary materials without appropriate authorization. You are responsible for the content you choose to share with other participants.

Marketing Media AI may moderate community spaces and may remove content, restrict participation, or suspend access to community features when reasonably necessary to protect participants, maintain the program environment, enforce these Terms, or comply with law.

Removal from a particular community feature does not by itself determine whether a refund is due. Any refund rights remain governed by the applicable purchase terms, these Terms, and rights that cannot lawfully be restricted.

Workshop Refunds

Refund and cancellation terms for a workshop, course, or program may vary by offering. The refund or cancellation policy presented on the applicable sales page, checkout, enrollment page, order confirmation, or other purchase-specific terms controls for that enrollment.

Because different programs may involve live scheduling, limited capacity, immediate access to digital materials, or other program-specific considerations, you should review the applicable refund terms before completing your enrollment.

Nothing in these Terms creates a broader refund right than the one provided for the applicable purchase, and nothing in these Terms limits any refund, cancellation, or consumer right that cannot lawfully be waived or restricted.
